    Flats in Queensgate Project of Hiranandani Estate township in Thane(W) is not getting registered in Thane Municipal Corporation , therefore the builder is not handing over the possession of the flat. Can somebody guide me what to do ? The date of possession was May - Jun 2007. What is the latest on Forest Land clearnaces issue and ULCA in Mumbai / Thane ???
    Please provide me the latest information. Thanx.

    Kindly, can you specific which builder is not handing over the possession of the flat.
    Queensgate Project registration will be starting in October at Thane Municipal Corporation office, Even the Forest Land clearnaces issue will be sorted out in next 2-3 months.

    I am talking about Hiranandani Builders.
    Kalpana October is already over ---- no progress on the issue. LOT OF SUSPENSE on the issue--- the BUILDER is NOT very forthcoming on the issue. Anu latest INPUTS pls ??????

    There are a no of buildings in Hiranandani Thane which are awaiting clearance. In case of Queensgate which was due for possession in Jun-2007, the clearance issue has still not been sorted so the property is not getting registered. Whenever I have contacted the Hiranandani team they are putting an excuse that things are not in their control. They charge a huge premium based on their brand but my experience has been pathetic.     Yes, I am also one of the unfortunates to have booked a flat in Queensgate which was expected to be handed over in May / June 2007. And Hiranadani Estates has not been at all responsive to my queries in this matter (may be becasue all transactions have been done only in name of Roma Builders and legally Hiranandani has not much stake in this). I definitely feel that TMC must expedite their approvals since the buyer is the only person suffering in such cases (Builder has already received more than 97% of his money) or Builder must do something to compensate the Buyer for such delays. But I really do not know how to proceed or whom to approach to get the correct status on this issue since I am presently posted out of Mumbai. Can someone advise?

    Let's as ask Hiranandani for compensation for delay in registration as 97% payment already paid more than 18 months before.

    For your information you have to pay interest 18% for any delay payment to Hiranandani.

    We should communicate and update each one for the compensation.

    I spoke to Mr. Prakash Shah, Vice President at Hiranandani (022-25762465) as well as Mr. Niranjan Hiranandani (022-25763600) regarding Queensgate registration and they wanted more time to resolve the issue. The number mentioned are direct numbers.

    The only resolution is that we should all unite and seek compensation. Can we go to some consumer court?
    Meanwhile we can keep on ringing these top execs and keep the pressure on so that we expect some action from builder.

    Can we speak to editor say Times of India so that this grievance is highlighted in their property edition? if this works,it will really make the builder realize the problem.

    Everybody is just talking about being united --- but nobody is contacting me on queensgate.hiranandani@yahoo.co.in ---- this e-mail I opened specially for tis purpose. Then I will mail all e-mail IDs to rest all --- and then a YAHOO GROUP can be formed --- after this we can certainly arrive at a decision to FIGHT OUT. ++++++++++++++++++++++++ Meanwhile I will request all localites to pay a visit to Mr. Hiranandani -- and all others can dish out letters to Hiranandani's by REGISTERED POST. Pls update each other on the minutest progress / input.

    spoke to the builder today. The issue of Queensgate registration is still not resolved. Getting the same 1 liner reply from Hiranandani.
    Please let me know if there is any other update.

    Had visited the builder's office in powai last sunday..according to Mr Mendon who apparently is in charge of Queensgate, the pending matter should be cleared by march end..but again...wouldnt count on the same...also what i gather is the matter does not have to do with ULCA as the building is not affected by th esame...what is pending is only the forest land issue.... has anyone here contacted or have information on who to contact in thee TMC or any other authourity who could give us information from the administration's side....Also does have any information on whether any interest would be given on advance payment amounts in case the possession is delayed (as the same was practiced in earlier buildings)... my email id is jayanmathews@yahoo.com (Contact No 9820053944)...The way i see it is that there are only 5 of us on this group... In case you have the contacts of more ..could you ask them to put up their email id's on thegroup..as we could get group messages goin which would be accessed more regularly by everyone (Not sure how popular this site i happened to visit by accident)..I also suggest meeting up once..in thane/powai itself...

    jayan i have been in touch with most of their officials and have been told the clearance will be thru by 1st week march but, have always pressurised them with queries regarding appropriate compensation in terms of interest in view of delay, increased stamp duty, possible rental income which one could have got etc but, they keep saying their management is yet to decide on this issue. i am sure if all of us keep writing, they must consider compensation therefore, keep the pressure on all of you. Also if you were informed that they have compensated in respect of other buildings, no reason why they should not do the same for queensgate.

    Arecent circular of the revenue and forest department has
    simplified the process of conveyance of immoveable properties in the
    state. Now, it is possible to register a property and assert one's
    right over it without waiting for a no-objection certificate from the
    various authorities concerned. The circular was issued on January 25,
    2008.
    In 2005, the Supreme Court, in a case that involved seven state
    governments as affected parties, had declared Section 22A of the
    Indian Registration Act as unconstitutional. This section made it
    compulsory to obtain NOCs from authorities such as the Collector, BMC
    or other local bodies to whom the land belonged. The Court also
    directed that no registrar or sub-registrar of assurances could refuse
    registration under any notifications issued under the provision. Such
    notifications had created stumbling blocks for many property
    transactions, as obtaining this NOC was a cumbersome process.
    VN Abale, section officer of the Revenue and Forest Department who
    issued the order says, "The recent order has directed the registering
    authority to set aside the requirement of NOC on government land.
    However we have also withdrawn the earlier government orders issued
    under 22A for other lands such as BMC, Trust land, local bodies and
    Waqf land. Now the requirement of even taking NA (Non Agriculture)
    permission and approved layouts before registering the document is not
    applicable."

    U all requested to call Hiranandani office and ask for regisrtation. Now they should not have any reason for delay and there is 50% reduction id registration as per Challenges ahead article for projects more than 100 acres.

    Dear all,

    As per Hiranandani officials the TOI news "Transfer made Easy" is not applicable for private forest lands. I made many calls to Girija secretary of Mr. Niranjan Hiranadani, After many trials I could able to speak Mr. Niranjan Hiranandani. He told me that they are trying their level best and there are two ways to resolve this one is court and another is administrative way. Since revenue department made erroneous entries Hiranandani is adopting administrative way. The day when I called him i.e. last Wednesday they got clearance for another two building (other than Queensgate). He told me that they are on the mercy of people (i.e. collector officials) since Hiranandani does not

    encourage under table business it is taking time. Its all matter of money.

    At this time if we file any case in court against builder then situation may get worst, since he is very clear about the clearance and all. This forest land issue came in June 2006, before that builder was having all clearances.

    I request all of you to keep on calling every day to following persons in Hiranandani, so that pressure on them will increase.

    1) Girija (Mr. Niranjan Hiranandani�s secretary) 022 25766705 Insist her to connect the line to Mr. Niranjan.

    2) Mr. Prakash Shah: 022 25763600 this is board no.

    3) Mr. Mendon: 022 25766742

    6) Mr. Popali: 09820757965 He signs on all agreements on behalf of Mr. Niranjan Hiranandani. & he comes with party for registration in register�s office.
