    I had booked a flat in Pune,the possession of which is due in the next month.
    At the time of booking,the builder had laid down the condition that I need to pay the maintainance charges for the next two years in advance at the time of possession.

    The builder is going to collect this lump some amount from every flat owner.This will come to a huge amount & its interest will also be enjoyed by the builder.

    My concern is,why am I required to pay the amount in advance?Can I not issue him postdated cheques for the monthly rentals?
    Is there a law/ruling governing the payment of maintainance charges to the builder.

    It depends on what benefit is the builder giving to the flat owners. Usually the maintenance of the Apartment complex is assigned to a professional Facilities Management company .An amount of say for example Rs 1.5 lakhs for 2 years will be collected from each Apartment buyer as Building Corpus Fund and the interest earned on this Fund will be utilized for payments to the Facilities Management company. Hence there will be no monthly Maintenance Charges.

    Many mid size builders collect fund to manage the maintenance fund till the society is formed, please make sure and get it signed from the builder that no maintenance will be charged to you for next 2 years.
    Check with Promoters and Builders Association of Poona and put your query in the greivence cell so that if any builder is mal practising, action can be taken.
