    I have rented out my flat to a couple who are senior citizens, living alone. As the lady is a patient, they are having a dog for their safety and security.
    The Secretary of the Co-operative Housing Society has asked me to take away the dog from the flat, saying that there is a resolution which has been passed by the society;as per that no one is allowed to keep a dog in the flat. There are some other members who have a dog in their flats in the adjacent wing which also comes under the control of the same housing society.
    When the same was referred to the Secretary, he said “They are living
    right from the beginning before the resolution was passed; but no new member/owner is
    allowed, after the date of resolution.”
    Under the above circumstances I request you clarify some of my doubts and guide me :

    1.Can there be different rules for different members of the society, depending upon
    the seniority of membership/earlier possession of the flat
    2.Is there any law which prevents the dogs from being kept inside the flat?
    3.In the event of an existing Resolution (not to allow dogs inside the flat)
    Is the resolution valid and enforceable?
    4.In case the resolution is valid and enforceable, can I get exemption from it?
    as a special case, on the grounds of security threat to the Senior Citizens
    5.Is there any law which can supersede the resolution (if it really exists) so that
    my tenants are not harassed and they are allowed to keep the dog inside the flat.

    Legally, the Secretary of the Co-operative Housing Society has the right to tell you about the law/Resolution the society has passed and you will have to abide by rules.
    You can make a request through formal letter addressing to the society about your special case. If the majority of the society committee members accepts your request you can allow your tenants to keep their pets.

    If the request results turns out to be negative and you still continue to allow your tenants to keep pets, society can take action against you in court.
