    I buy a flat in 2003.i have completed all the formalities like stamp duty registration.Due some dispute with society, society is not ready to transfer share certificate on my name as well they are charging me a non occupancy charges.
    Need a help on this as share certificate is not transfer, can society charge me non occupancy charges after doing stamp duty registration?
    can i go to the consumer court for this? pls. guide me

    Make an application to the society alongwith the prescribed fees for getting a your share certificat supported by an affidavit duly notarised. Agains, since Im not aware of the dispute cannot comment further.

    Non occupancy charges are levied by the society on the member who sub-lets his/her flat by giving it on leave-and-license basis or parts its possession in any other manner for a period of 11 months or more to an outsider and not a family member.
    Non occupancy charges shall be charged in accordance with the circular issued by the Commissioner of Cooperation, Government of Maharashtra. The society can charge a maximum of 10 per cent only as non occupancy charges.
